Our chair has resigned with immediate effect, we have a board member who is temporarily able to do it but they need a suitable person and I know they won't be able to do this interview with their work commitments. I've offered to do it but I said they need to check constitution first.

It all seems like an oh yeah we will sort it type thing with no rush but I'm in panic mode! How long do you get to nominate and get someone to start the process of becoming chair? Anyone been through this (I know a good few will have) where your just left without a chair.

I've informed the committee that the chair must notify Ofsted indenpendently that they have resigned as we can not do it for them, also last panic has anyone found that if this has happened Ofsted seem to inspect you not long after?

How is your management set up? It will come down to what is stated in your constition. We are parent run group running on PSLA 2011 constitution. This does allow staff to be on the committee. We went through a period of member of staff being Chair - we had to have a vice chair to take over when conflicts of interest eg wage increases. They also had to fill in health declaration and pre-school had to pay £90 for medical!

It will depend what is says in your constitution. It may say she can't resign until a suitable person is found.

 

Could you send off a EY3 removing her and giving ofsted the new details. Its not always the chair that is the nominated person, could someone else do it? Is there a vice chair that can step up?

 

This is a real problem with committee run groups as if anything tricky happens they don't know how to deal with it and just resign.

I'm the third Chair at preschool in the last ten months. None of the changes so far have triggered anything, although the EY3 form ready to send here next to me, may be the straw that breaks the camel's back. Time will tell.

I'll get the secretary to look at which constitution we are under, I have my suitable persons so should be able to take straight over and I'm on update service it would be better option as I'm down as a contact person with Ofsted but then they still don't fully talk to me.

The chair has resigned from long standing after an issue and is refusing to do any work like payment authorising etc, I'm worried that a time lapse of not notifying Ofsted of new nominated person/chair leaves us vulnerable or at worst possible closure.

The secretary has said they will step up to be a temporary chair/nominated person but won't be able to get suitable person interview done.

 

I'll look into our constitution, it lovely having volunteers but sometimes the shear gravity of situations aren't as real to them when then don't know Ofsted like we do.

I'll also look at nominated person not being that of the chair but of a committee member.

Our constitution states that the chair cannot stand down until another suitable person is found. So even if they tender their resignation it cannot be accepted until there is a replacement, even if they don't do anything, they are there in name only.

Sorry to hijack a old post.

 

I am considering standing down as Chair for our Pre-school as much as I have enjoyed being involved my personal circumstances have changed and the workload is actually quite alot (busy year with a few big staff and recrutiment issues have left me stressed unhappy and fed up)

 

Our constituton is an old PLA one from 2008. It simply states in the event of death or resignation of a committee officer a member of the committee should fill the position until the next AGM. There is nothing else mentioned.

 

I am sure no one on the current committee would want to take over the role or how they would even manage to find someone else to take over.

 

If guess my questions are,:

Could the committee continue without a a chair until one can be found?

Would it be best for me to stand down at the next AGM or before. I'm willing to see it out until then (October)?

 

I am also the nominated person with Ofsted there is no reference to this in our constituton

 

This isn't an easy decision as I love our setting and supporting everyone but I need to put myself and family first.

Are you a member of the PLA or NDNA? I would get in touch with them, it seems as though there are several complex issues that you need to talk through. Your local authority should also have an advisor who is responsible for your area/remit, an urgent meeting with them seems to be in order!
